2.  (i) Any personal data that may be made known to MindsOn through electronic mail orotherwise may be be used by us in accordance with our Privacy Policy and you agree to accept MindsOn’s Policy which is available on the Privacy Policy page. (ii) In no event shall we be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of the service.

3. You hereby declare and guarantee: (i) you are legally authorized to enter into and comply with the provisions of these Terms, (ii) your use of the MindsOn Website will not violate any copyright, trademark, right of publicity or any other legal right of any third party, and (iii) you will comply with all applicable laws and regulations in utilizing the Website and in engaging in all other activities arising from, related to or connected with these Terms.

4.  MindsOn shall not be held responsible for any harm resulting from your failure to access, play, or use the Website or the content featured on it, nor for any injury caused to your computer and/or its associated systems due to its incompatibility with the technical specifications posted on the Website.

5. The MindsOn Website is subject to constant change. You will not be eligible for any compensation because you cannot use any part of the Website or because of a failure, suspension or withdrawal of all or part of this Website.

This Website and the underlying computer code used by us to design, operate and maintain the Website and all content and material contained within or available on the Website provided by us is protected by international rights of copyright, trademarks, patents, database rights, domain name rights, trade secrets and/or other proprietary intellectual property rights and laws internationally. Unless expressly authorised by us, you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publish, adapt, edit or make derivative works from materials or content provided by us and made available on the Website.

14. Notwithstanding the above, you may read the content and materials on the Website within the use of normal and non-commercial use of the Website.

Any reference to tests by MENSA on this website is for informational purposes only and does not imply any form of association with or endorsement by MENSA INTERNATIONAL whatsoever. We are not affiliated with, endorsed by, sponsored by, or otherwise connected to Dr. Jackson G. Lu of the Massachusetts Institute of Technology (MIT) or any of his colleagues, collaborators, or research teams in the field of AI and human behaviour research. Any mention of Dr. Lu or his work on this site is incidental and does not imply any endorsement, partnership, or responsibility for research, opinions, or services. Some images and graphics displayed on this website, including but not limited to employee or customer-related graphics, are for illustrative purposes only and do not necessarily depict actual employees, customers, representatives or affiliates of our company or company units. MindsOn will not be accountable to any third-party for the suspension, alteration or termination.

20. These Terms shall supersede any and all other conditions, understandings, commitments, agreements or representations (except fraudulent misrepresentations) relating to your contracting or purchases, whether oral or in writing, and contain the entire agreement between us and you relating to your purchase or contracting of services.  We advise that you print off and keep safe a copy of these terms and conditions once any orders have been accepted by us.  You are further advised to read (and are responsible for reading) all information on this website fully.

21. Should any provision(s) of these Terms be declared invalid or unenforceable, it/they shall be omitted and the remaining terms shall remain in effect.

Governing Law

These Terms are subject to the laws of England and Wales, the courts of which shall be the courts of exclusive jurisdiction.

Changes to Terms

MindsOn reserves the right to modify, alter or replace these Terms at any time. We will post the new version on the MindsOn Website. Whenever we do this, a notice will be posted notifying of the changes on the Website’s homepage. Your usage of the Website from the specified date that the revised terms are posted on the Website onwards shall be governed by those fresh terms. Your use of the whole/any part of the Website following such change shall be deemed to be your acceptance of such change.
